Buying, selling or possessing counterfeit tobacco: the legal exposure explained

Smoke Mart Australia graphic: The legal exposure

Illicit tobacco is not a victimless bargain. Australian law makes manufacturing, selling and buying it offences, with penalties that rise steeply with quantity — and the framework is designed to reach the buyers as well as the sellers.

Check What to expect
Conduct Maximum exposure
Possessing 2 kg to under 5 kg Civil penalty provisions, up to about $36,400
Possessing 5 kg or more Up to 5 years and substantial fines
Selling or buying illicit tobacco Up to 5 years
Manufacturing Up to 10 years

Why buyers are in scope

The enforcement framework assumes illicit supply cannot function without illicit demand, so purchasing is treated as part of the offence rather than a private choice. Penalty units — $364 from 1 July 2026 — set the scale of the fines.

The practical rule for buyers

One test keeps you clear: buy only where the price contains the duty the product must carry. If the arithmetic cannot work, the transaction is not a discount — it is exposure.

Before you order — four checks that never change

  1. Price against the excise floor. Duty is $1.55274 a stick from 1 September 2026 — about $31 in a 20-pack and $310 in a carton. A cheap carton is a legal risk, not a saving.
  2. The pack in the photo. Legal Australian stock is drab brown (Pantone 448C) with graphic warnings covering at least 75% of the front and 90% of the back — no logos, no brand artwork.
  3. Age and delivery. Distance sellers must verify you are 18 or over, and somebody who can sign and show ID has to be at the address. Lockers and unstaffed addresses can be refused.
  4. State rules. South Australia prohibits mail and online tobacco orders outright; everywhere else requires an age-verification system.
