“Cheap smokes online”: why the duty floor means they cannot exist lawfully

Smoke Mart Australia graphic: Why "cheap smokes" fail

The phrase “cheap smokes online” is one of the most searched tobacco terms in Australia, and it describes something the tax system has made structurally difficult: excise is $1.55274 per stick, so a carton carries about $310 in duty before GST and margin. Only two kinds of sellers undercut that.

Check What to expect
Seller How they price it
Compliant retailer Duty + GST + thin margin; small spreads between brands
Discounting on freight Free or flat delivery, not on tax
Grey market Untaxed stock; price far below the floor
Counterfeit Fake product; price far below the floor

What legitimate savings look like

Delivery thresholds, carton freight savings and modest first-order discounts: real, small and funded from margin. An order discount is fine; a price that cannot contain the duty is not a discount at all.

What the illegal options cost you

Seized parcels, no invoice, no recourse, unknown product, and criminal exposure for buying illicit tobacco — up to five years for larger quantities. That is a poor trade for a saving that should not exist.

Before you order — four checks that never change

  1. Price against the excise floor. Duty is $1.55274 a stick from 1 September 2026 — about $31 in a 20-pack and $310 in a carton. Two ways to sell below the duty floor: untaxed stock or fake product. Both are offences.
  2. The pack in the photo. Legal Australian stock is drab brown (Pantone 448C) with graphic warnings covering at least 75% of the front and 90% of the back — no logos, no brand artwork.
  3. Age and delivery. Distance sellers must verify you are 18 or over, and somebody who can sign and show ID has to be at the address. Lockers and unstaffed addresses can be refused.
  4. State rules. South Australia prohibits mail and online tobacco orders outright; everywhere else requires an age-verification system.
